Анотація


MODERN TRENDS OF THE AGRARIAN LEGISLATION DEVELOPMENT

Implementation of agricultural production is accompanied not only with waif use of natural resources, especially agricultural land, but also with heavy pollution. The level of environmental safety is getting worse in this field. In the context of the aforementioned, recognition of the need for «greening» of the agrarian  legislation to preserve the rural landscape and ensuring a gradual increase of quality of life for people living in rural areas is of key importance.

Theoretical basis for this study were scientific works of scholars such as Andreytsev, V. I., Bagay, N. O., Ermolenko, V. M., Kostytsky, V. V., Kulinich, P. F., Kurman, T. V., Makarova, T. I., Malysheva, N. R., Petrov, V. V. and others.

The purpose of this article is realization of the methodic theoretical and legal analysis of the environmental regulations impact on the agrarian legislation development, establishing a range of public relations regulated by agrarian legislation and discovering the meaning of «greening of agrarian legislation».

The role of the agrarian law as a branch of law have to ensure proper legal regulation not only of relations connected with organization of agricultural production but also the social relations and rural development, that are acting as integral and indispensable part of its subject. End of the process of decay and impoverishment of the peasants is possible only with solution of social problems of rural residents, creation of legal mechanisms to improve living conditions in rural areas, decreasing the gap between the level of rural and urban life.

It should be noted that the relations of social development of rural areas, primarily aimed on improving the level and quality of life of the rural population. The concept of «quality of life» is associated with complex characteristic of climatic, social, economic, environmental and cultural conditions of the population.

Complex approach for solving such important issues as the preservation of natural and cultural landscapes, guarantee of food security and poverty alleviation of rural residents is possible within the concept of rural development. Under the EU law rural development implements by using all types of resources available on rural areas (human, natural, historical, etc.). Prospects for rural development are linked not only with agricultural production, but also with improvment the level and quality of life of the rural population. For this purpose, the development of non-agricultural activities (rural tourism, arts and crafts, rural afforestation etc.) and implementation of measures to improve the environmental situation are encouraged. Moreover, special attention in the process of development of rural areas in the EU is paid to the daily rural life application of innovative technologies aimed at the rational use and conservation of natural resources (development of renewable energy and energy efficiency, the implementation of research and investments related to the conservation, restoration and upgrading of cultural and natural heritage of villages and rural landscapes and natural subjects of high value,  development of ecological settlements, etc.).

Taking into consideration that the subject of agrarian  law consists of a set of social relations in the sphere of agricultural production and social development of the rural areas, it would be logical to define the process of greening of agrarian  legislation as the introduction of environmental principles into the content of acts of the law wich regulate agrarian relations.

Moreover, the greening of agrarian legislation should aim to preserve rural areas as spatial framework for the allocation of natural resources, to maintain ecological agricultural production and to create conditions for gradually improving the quality of life.
