ON THE QUESTION OF CRIMINAL AND LEGAL CHARACTERISTICS OF ILLEGAL GAMBLING GAMES
Abstract
Abstract. Relevance of the сriminally-legal research of crimes in illegal gambling due to the fact that only slightly more than 1% in Ukraine raised criminal proceedings for such offenses were sent to the court with accusatory acts.
The purpose of this study is to determine the current state of the current criminal law for the qualification of crimes in illegal gambling and proposals for its improvement.
Questions of the criminal legal character of illegal gambling were studied in the article. Tthe most common types of business activities in illegal gambling were analyzed and identified. The criminal laws relating to combating illegal gambling of certain foreign countries were examined. It was studied some issues of subjective and objective aspects of the crime therein gambling.
It is proposed to supplement Art. 203-2 of the Criminal Code of Ukraine provisions on criminal responsibility for gambling occupation by prior agreement by a group of people in an organized group or criminal organization, as well as the involvement of minors to participate in illegal gambling.
