Environmental and legal regulation of the use of soils

Regulation of the use of soils by environmental law has been reviewed. The characteristics of application of legal forms of social relations to soils as objects of the right of use and legal protection within the scope of their legal regime have been provided. The concept of rational use of soil as an object of land, environmental and agricultural relationships was substantiated. It was established that the existing land law regulates rational use of land deeper, and the center of attention has shifted from regulation of legal relationships concerning development of new areas to regulation of relationships concerning quality and efficient use of areas in order not to cause damage to the genesis and evolution of soil during intensive cultivation. Particularities of legal protection of soils have been highlighted. Based on a legal analysis, a conclusion was drawn concerning the notion of rational use of soils including the set of requirements concerning their quality and efficient use, and the notion of legal protection of soils covers the set of legal measures aimed at the compliance with these requirements, and also, measures of enforcing the said compliance.
