To the definition of "legal culture" in law

Abstract

The article describes the role of legal culture in the construction of the rule of law, the formation of civil society, in the history of mankind and in the life of an individual. Attention is focused on the need to identify the signs of culture, to define culture and legal culture, which will expand the conceptual and categorical apparatus of the study of legal culture, to outline ways of further General theoretical analysis of its features and structural elements, to form its functions in the implementation of national security policy in the socio-economic, political and regional spheres of public life, preservation of historical heritage and national identity of Ukraine, overcoming internal and external threats to its sustainable state and legal development.

According to the results of the study it is established that the integral concept of legal culture in the domestic legal science is not yet available. When describing the legal culture, it is necessary to take into account the polysemantic concept, the combination in the category of «legal culture» cultural («culture») and legal phenomenon («law») and the presence of different methodological approaches to its study. The analysis of semantic meaning of the word «culture» is carried out, seven signs of culture which are based on such concepts as the person, consciousness, activity, activity, social orientation, a vital position, values are allocated, the concept of culture and legal culture is formulated.
