Determination of legal basis for the application of status of pedigree animal according to the legislation of Ukraine

A certain part of high quality animals in Ukraine does not have breeding status due to the imperfection of the legal provision of the breeding affairs, which hinders the development of the livestock sector. The purpose of the work is to investigate the legal grounds for recognizing an animal in the status of pedigree animal , to establish gaps in the current legislation in the sphere of granting animals the status of breeding animals and to develop proposals for their elimination.
The system-structural, comparative-legal and formal-legal methods of research were used in the work.
It has been established that gaining an animal status of pedigree animal depends directly on the legal status of the enterprise (legal entity) to which this animal belongs. At the same time, in Ukraine there are owners of high-quality pedigree animals that can not be recognized as subjects of the breeding affairs in accordance with the requirements of the current legislation. It is proposed to introduce amendments to Article 1 of the Law «On Breeding Affairs in Livestock» and to the «Procedure for the Approval of the Appropriate Status for the Subject of Breeding Affairs in Livestock» (Order of the Ministry of Agrarian Policy and Food of Ukraine dated June 19, 2015, No. 234. Scientifically substantiated proposals on elimination of legal obstacles in expanding the range of subjects of the breeding business have been developed in order to attract a larger array of animals to the cause of qualitative improvement of the existing livestock.
