Public property land transfer into territorial community property as the basis for municipal property land right in Ukraine

The article analyzes the transfer of state-owned land plots to territorial communities as the basis for municipal property land right within the local self-government reform processes in Ukraine.
Land is a special natural resource. Land is the basis, material and financial basis of local self-government. Following the adoption of laws on the decentralization of powers, communities receive the right to dispose of the land of settlements. The process of decentralization can not be completed without the transfer of the full rights of the owner to the territorial communities and the powers of disposal of land throughout the community, including outside settlements. This should be facilitated by the legislative consolidation of the grounds for acquiring the right of communal ownership of land.
Territorial communities have a real ability to dispose of land plots of communal property, to carry out administrative powers for all the lands within the settlements and to influence the definition of the legal regime for the use of land outside the settlement.
The study results reveal that territorial communities have the real ability to directly dispose of municipal property land plots, to carry out administrative powers related to all lands within settlements as well as to influence determining the legal regime of using land outside the settlement.
It is established that a special legal act is necessary to adopt in order to realize the right of municipal land ownership outside the settlements which entitles the representative bodies of the united territorial communities to exercise their rights of agricultural land ownership both within and outside the settlement, as well as to have tools to manage the municipal property land of the united territorial community.
For the practical solution of the violated legal problems, the proposal for the adoption of a normative legal act under which the representative bodies of the OTG will be empowered to exercise the rights of the owner of the territorial community on the land within and outside the settlement, as well as the powers of management of communal land ownership in the territory of the united community.
