Abstract

The relevance of the study is determined by the need to transform Ukraine’s land protection system under large-scale war-induced and technogenic disturbances of land and soil cover and the emerging tasks of post-war recovery. The aim is to substantiate theoretically and methodologically the directions of transformation of the national land protection system with due regard to safety, environmental, land-management, monitoring and European integration requirements. The methodological framework combines systemic, structural-functional and comparative legal approaches, content analysis of regulatory and scientific sources, and logical modelling. The study substantiates that a post-war land protection system should integrate information on explosive ordnance contamination, the actual condition of soils, cadastral and legal characteristics, land-management decisions, recovery financing mechanisms and subsequent monitoring. Institutional-legal, ecological-economic, land-management and planning, monitoring, and war-recovery approaches are systematised. It is proposed to complement the principles of state land-protection policy with the principles of environmental safety of post-war land use, safe return of land to use, approximation to EU law and policy, soil health, ecosystem integrity and climate-resilient land use. The scientific novelty lies in a holistic interpretation of land protection as a system for managing the safety, condition and recovery of land resources. The practical significance consists in the possibility of using the results to improve regulatory provisions, land-management support and monitoring of post-war land recovery.
